Terms of Service
Please read these terms carefully before using Kiko & Manyi. They form a legally binding agreement between you and us.
1. Acceptance of Terms
By accessing or using the Kiko & Manyi website, mobile application, or any related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms apply to all visitors, users, and customers. We may update these Terms at any time; your continued use after changes are posted constitutes acceptance.
2. Eligibility
You must be at least 18 years old to create an account and place orders. If you are between 13 and 17, you may only use the Service under supervision of a parent or guardian who agrees to these Terms. By using the Service, you represent and warrant that you meet these requirements.
3. User Accounts
- •You are responsible for maintaining the confidentiality of your account credentials.
- •You are responsible for all activity that occurs under your account.
- •You must notify us immediately of any unauthorised use of your account.
- •We reserve the right to terminate accounts that violate these Terms.
- •You may not create multiple accounts to circumvent restrictions.
4. Intellectual Property & Content
Your content
You retain full ownership of artwork, images, and designs you upload ("User Content"). By uploading, you grant Kiko & Manyi a limited, worldwide, royalty-free licence to reproduce, process, and display your User Content solely for the purpose of providing the Service (e.g. printing on garments, showing previews).
Your responsibility for content
You represent and warrant that you own or have the right to use all User Content, that it does not infringe any third-party intellectual property rights, does not contain illegal, defamatory, or harmful material, and that it is appropriate for all audiences. We are not liable for User Content and may remove content that violates these Terms.
Our content
All platform content — including the website design, AI models, logos, software, and text — is owned by Kiko & Manyi or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
AI-generated designs
Designs generated using our AI tools are based on your prompts. You own the output for personal and commercial use on garments ordered through our Service. You may not resell AI-generated designs as standalone digital assets.
5. Prohibited Uses
You agree not to use the Service to:
- •Upload or create designs that infringe third-party copyrights, trademarks, or other IP.
- •Create designs that are pornographic, hateful, discriminatory, threatening, or otherwise illegal.
- •Use automated systems, bots, or scrapers to access the Service without permission.
- •Attempt to reverse-engineer our AI models or proprietary software.
- •Circumvent any access controls, security features, or payment requirements.
- •Engage in fraudulent transactions or chargebacks in bad faith.
6. Orders, Pricing & Payments
- •All prices are displayed in Singapore Dollars (SGD / S$) unless otherwise stated. Prices are subject to change without notice.
- •Orders are confirmed only after payment is successfully processed.
- •We reserve the right to cancel orders at our discretion (e.g. suspected fraud, production issues).
- •Payment is processed by our third-party payment providers; we do not store card details.
- •Applicable taxes and duties may be charged separately depending on your location.
7. Production & Shipping
Each item is custom-printed to order and typically dispatched within 5–7 business days. Delivery times thereafter depend on your location and selected shipping method. We are not responsible for delays caused by carriers or customs authorities. Please review our Shipping Policy for full details.
8. Returns & Refunds
Because every garment is custom-made, we generally cannot accept returns except in cases of manufacturing defects or errors we caused. Please review our Refund Policy for full details on how to request a replacement or refund.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Kiko & Manyi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EU, you may also have the right to use an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, provisions that by their nature should survive (IP, liability limitations, dispute resolution) will remain in effect.
